At Bay State Surplus, customer safety and privacy are our top priorities. We are dedicated to handling your personal information securely and in compliance with all applicable privacy laws. Please review our privacy and safety practices below:

  1. Personal Information: We collect personal information such as name, address, contact details, and identification documents exclusively for the purpose of completing firearm sales and fulfilling legal requirements. Your information is kept strictly confidential and will only be shared with third parties when required by law.

  2. Online Security: Our website uses industry-standard encryption and security measures to protect your personal data during online transactions. While we maintain rigorous security practices, Bay State Surplus is not liable for unauthorized access or data breaches beyond our control.

  3. Firearm Background Checks: All customers must pass a background check conducted by the appropriate authorities prior to taking possession of a firearm. Bay State Surplus strictly complies with all federal, state, and local laws regarding firearm transactions and background checks.

Customer Care

Bay State Surplus is committed to delivering excellent customer service and ensuring a positive shopping experience. Our key customer care policies include:

  1. Payment Options: We accept:

    • Cash

    • Money Order

    • Certified Cashier's Check

    • Credit/Debit Cards (Discover, AMEX, Visa, Mastercard)

    Note: Credit and debit card payments are subject to a processing fee of 3.5% plus $0.35 for in-store purchases, and 2.9% plus $0.35 for online purchases. These rates may change over time. Customers will be responsible for the processing fee rate in effect at the time of payment.

  2. Payment and Refunds for Firearms:

    • Full Payment Required: Payment for firearms must be made in full before any background check is conducted.

    • Failed Background Check: If a customer fails the background check and is found ineligible to receive the firearm, a refund will be issued minus a 5% fee deducted from the original purchase price.

    • Customer-Initiated Cancellation: If a customer chooses to cancel their purchase after payment, the refund will not include the processing service fees paid. (3.5% + $0.35 for in-store, 2.9% + $0.35 for online; subject to current rates at the time of payment.) Exception: If the cancellation is due to a listing error or incorrect information on the part of Bay State Surplus, the processing fee will also be refunded in full.

    • Cancellations Due to Background Check Delays: If a customer cancels or requests a refund due to a delay in their background check, Bay State Surplus reserves the right to charge our standard $45 transfer fee for performing the background check service.

  3. Returns and Refunds: We provide accurate product descriptions and images so customers can make informed purchases. If dissatisfied for any reason, contact customer service within 14 days of receiving your item to initiate a return.

    • Refunds will be issued by the original payment method, excluding shipping fees and any applicable restocking fees.

    • Processing service fees will not be refunded (unless due to Bay State Surplus error, per above).

  4. Firearms Safety and Training: We strongly encourage all firearm owners to participate in accredited firearms safety and training programs. Safe handling, storage, and usage of firearms are the responsibility of each customer.

  5. Firearm Storage Fee Policy: A. Storage Fee: Firearms left at our store for over two (2) weeks incur a $15 per week storage fee. B. Exceptions: This fee does not apply if your firearm is with us for pre-arranged services such as gunsmithing or custom modifications where a longer retention period is expected. C. Notification: Customers will be notified in writing when a firearm remains in our store past the initial two-week period. A courtesy reminder will be provided prior to any charges being applied. D. Billing: Storage fees accrue weekly and must be paid in full before the firearm is released to the customer.

Refunds and Processing Fees

For the avoidance of doubt: Any refund issued that is not directly due to an error or mistake on the part of Bay State Surplus will be subject to the processing fees charged by the applicable payment platform. Processing fees are determined by the payment method and/or platform provider (such as credit card companies, online payment gateways, or third-party processors) and reflect the rates in effect at the time of the original transaction.

  • This includes, but is not limited to, customer-initiated cancellations, background check failures, delayed background check cancellations, or any reason other than a proven error by Bay State Surplus.

  • Where a refund is required due to a Bay State Surplus listing error or incorrect product information, the processing fee will be refunded in full to the customer.
